There's a bug with whirlwind attack. It's a known bug that's been around since the 1.69 patch came out... it's been fixed on windows servers, but bioware never fixed the linux, or mac servers (some windows servers still have the issue). We run the linux version of the server and so we are affected by the bug. I've implemented a fix, try it out and report your findings here. So far after the fix my character with ww attack has not been bugged.

My whirlwind seems to work. It does have a 6 second timer on it though, dont think ive never seen that before.

normally it's a 3.8 second timer so the animation finishes firing. I made it a six second timer to work around the bug. We can try to lower the timer a little each try to see how low we can get it before the bug comes back and your action queue locks up. This bug affects NPCs with whirlwind attack as well as PCs. Having a 6 second timer just means you can only do it once per round, which I believe is all you could do before anyway.
